Criminal Infractions
Summary of “Criminal Infractions”
Attorney Stephen Higgins speaks about criminal infractions and why it’s important to have an experienced attorney on your side.
Sometimes when you’re stopped by an officer you receive what’s called a Criminal Infraction. What that means is, in most Florida counties, you have to request a Court date within a certain timeframe. Sometimes the officers will indicate on the bottom of the infraction that there’s a Court date that’s upcoming. One of the most important things that we can do on those types of cases is to get the paperwork into the State Attorney’s Office. The reason we need to do that is it’s a criminal infraction. If it’s going to require a court appearance, it’s going to require some negotiations with the State Attorney. It is not the type of situation where you want to go in on any type of criminal infraction, plead guilty and be at the mercy of the Judge. I would call our office immediately so we can get the necessary paperwork into the State Attorney. We can then begin negotiating with them to get you the result that you feel is best.
